Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Zana platform and related services provided by Anqor Studios ("we," "us," or "our"). By using our services, you agree to these Terms.

1. Services

Zana is a content production, lead generation, and sales automation platform. Our services include but are not limited to:

Automated content research, scripting, and strategy
Lead capture, scoring, and pipeline management
Email sequence automation and sales support
Performance analytics and reporting
Client dashboard and content management tools

2. Account Registration

To use our services, you must complete our client intake process and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3. Acceptable Use

You agree not to:

Use the services for any unlawful purpose or in violation of any applicable laws
Send spam, unsolicited communications, or misleading content through the platform
Attempt to gain unauthorized access to our systems or other users' accounts
Reverse engineer, decompile, or attempt to extract the source code of our platform
Use the services to generate content that is defamatory, obscene, or infringes on third-party rights
Resell, sublicense, or redistribute the platform or its outputs without our written consent

4. Content Ownership

Your Content

You retain ownership of all content you provide to us (brand assets, intake responses, business information). You grant us a limited license to use this content solely to provide and improve our services to you.

Generated Content

Content generated by Zana (scripts, posts, email sequences, thumbnails) is created for your use. Upon full payment, you receive a perpetual, non-exclusive license to use all generated content for your business purposes. We retain the right to use anonymized, aggregated data to improve the platform.

Our Platform

Zana, including its agents, workflows, dashboards, and underlying technology, remains the intellectual property of Anqor Studios. These Terms do not grant you ownership of the platform itself.

5. Payment Terms

Fees are charged on a monthly retainer basis as agreed in your service agreement.
Payments are processed through Stripe. You authorize recurring charges as specified in your plan.
Fees are non-refundable except as specified in Section 6 (Refund Policy).
We reserve the right to adjust pricing with 30 days written notice.

6. Refund Policy

First 14 days: If you are unsatisfied within the first 14 days of your initial subscription, you may request a full refund.
After 14 days: Monthly fees are non-refundable. You may cancel your subscription at any time, and service will continue through the end of your current billing period.
Unused credits or services: No refunds are provided for unused portions of a billing period.

7. Service Availability

We strive to maintain platform availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience downtime. We will provide reasonable notice for planned maintenance when possible.

8. Data Processing

We process your data in accordance with our Privacy Policy. By using our services, you acknowledge that:

AI models (including Claude by Anthropic) process your content and lead data to deliver services
Third-party APIs (YouTube, Instagram, LinkedIn, etc.) are used to gather publicly available data
Lead data captured through the platform is stored and processed on your behalf
You are responsible for ensuring your use of captured lead data complies with applicable laws (including GDPR, CAN-SPAM, and other anti-spam regulations)

9. Email & Communication Compliance

Automated emails sent through the platform on your behalf must comply with applicable laws including CAN-SPAM, GDPR, and CASL. You agree to:

Only send emails to recipients who have provided consent or with whom you have a legitimate business relationship
Include accurate sender information and a functioning unsubscribe mechanism
Honor opt-out requests promptly

10. Limitation of Liability

To the maximum extent permitted by law, Anqor Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, profits, data, or business opportunities, arising from your use of the services.

Our total liability for any claim arising under these Terms shall not exceed the total fees paid by you in the 3 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Anqor Studios from any claims, damages, losses, or expenses (including legal fees) arising from: (a) your use of the services, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) content you provide or publish through the platform.

12. Termination

By you: You may cancel your subscription at any time. Service continues through the end of the current billing period.
By us: We may suspend or terminate your access for violation of these Terms, non-payment, or at our discretion with 30 days notice.
Effect of termination: Upon termination, your access to the platform ceases. We will retain your data for 30 days to allow export, after which it will be deleted.

13. Dispute Resolution

These Terms are governed by the laws of the United Arab Emirates. Any disputes arising from these Terms or the services shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the courts of Dubai, UAE.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the platform. Continued use of the services after changes take effect constitutes acceptance of the updated Terms.
